The above costs are for straightforward transactions. If further work is required at any time during the course of the transaction, then an additional charge will be made.

ESTATE PLANNING COSTINGS

The normal documents which we prepare for an estate planning exercise are:

  1. Deed of Family Trust
  2. Agreement for Sale and Purchase (or Deed of Nomination)
  3. Deed of Acknowledgement of Debt (securing debt-back and further advances)
  4. Deed of Forgiveness of Debt (first gift)
  5. Authority and instruction form(s)
  6. Notices of Sale
  7. Settlement Statement
  8. Will(s) or Codicil(s) to Will(s)
  9. Minutes of Meeting of Trustees
  10. Enduring Powers of Attorney for Property and Personal Care and Welfare

The cost of this is usually between $2,000.00 and $2,750.00.  If there is a mortgage on the title, then this may also involve a discharge of same and a substitute mortgage being taken. This would cost a further $650.00 (appox) plus any bank consent/discharge fees.

Assuming that gifting is required, the ongoing annual legal cost is currently $350.00 per annum but subject to review from time to time.

We believe costing is very reasonable.  It is necessary when comparing costs to compare apples with apples, as other quotations may embrace only minimum documents.

 

TIME AND ATTENDANCE MATTERS

Time and attendance matters (principally litigation and opinions) are  costed at a minimum of $300.00 per hour plus GST and disbursements.

Declarations and Affidavits $10.00 each + 50 cents per exhibit
Passport/Citizenship (including photos) $50.00
Witnessing/Certifying Copies of Documents $5.00 each page
Notarising of documents

$50.00 for the 1st document
$30.00 for each other document
$20.00 for each copy of same document
+ GST on all above amounts
